    The sales contract is a private contract signed in the presence of a notary. The notary is the one who is responsible for authenticating the sales contract and concluding the sale of the property between the buyer and the developer.

    At the stage of concluding the sales contract at the notary’s office, the purchaser has to pay additional costs in addition to the price of the property. However, a large majority of the notary’s fees are not retained by the notary. The fees are made of :

    • Fees and taxes: These are amounts imposed by the State ( for instance: the registration fees at the land registry). The notary collects the taxes and transfers them to the National Treasury.
    • The additional costs : the notary will have to advance various expenses on behalf of his client: the remuneration of the various people involved, and the payment of the various administrative documents.

    The fees: This part of the total cost goes to the notary and his collaborators in the notary’s office as remuneration.

    Co-ownership is a form of real estate ownership shared by several co-owners, each of which includes a private space and a shared common area.

    Co-ownership is governed in Morocco by law N° 106-12, modifying and completing law N°18-00 relating to the status of co-ownership of built-up buildings.
